Terms of Service

1. Acceptance of Terms
By accessing or using ProxiVeil ("the Service"), operated by BC Digital Consulting LLC ("we," "us," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service. These Terms apply to all users, including individual users, organization administrators, and team members invited to an organization account.
2. Description of Service
ProxiVeil is an AI-powered security operations platform designed for small and mid-sized businesses. The Service provides automated analysis of uploaded security data, including vulnerability scans, log files, phishing emails, and other security artifacts. Analysis is performed using artificial intelligence to generate reports, recommendations, and operational insights. The Service does not replace professional security judgment and should be used as a tool to augment your security operations.
3. Account Terms
You must be at least 18 years of age to create an account and use the Service. By registering, you represent that you meet this requirement.
You must provide accurate, current, and complete information during registration and keep your account information up to date. Each individual may maintain only one account. Sharing account credentials is prohibited.
Organization administrators are responsible for all activity that occurs under their organization account, including activity by team members they invite. Administrators are responsible for managing team member access and ensuring compliance with these Terms by all members of their organization.
4. Acceptable Use
You agree not to use the Service to:
- Engage in any illegal activity or violate any applicable law or regulation
- Upload files containing malware, viruses, or other harmful code with the intent to damage or disrupt the Service or other users
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Scrape, crawl, or use automated tools to extract data from the Service beyond the provided APIs
- Attempt to gain unauthorized access to other users' accounts, data, or organization resources
- Resell, sublicense, or redistribute the Service or its outputs without prior written consent
- Interfere with the integrity or performance of the Service or its infrastructure
5. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Personally identifiable information (PII) is automatically stripped from uploaded security data before it is sent to our AI analysis engine. This includes email addresses, usernames, IP addresses, fully qualified domain names, and other identifiers. All data is encrypted at rest using AES-256 encryption and in transit using TLS 1.2 or higher.
6. Intellectual Property
The Service, including its software, design, features, documentation, and all related intellectual property, is owned by BC Digital Consulting LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You retain all ownership rights to the security data you upload to the Service. You also retain ownership of the analysis reports generated from your data. By uploading data, you grant us a limited license to process and analyze that data solely for the purpose of providing the Service to you.
7. Subscription & Billing
ProxiVeil offers subscription plans billed on a monthly or annual basis. All new accounts include a 14-day free trial period. You will not be charged until your trial expires, at which point your selected plan will be activated and billing will begin.
You may cancel your subscription at any time. Upon cancellation, your account will be downgraded at the end of the current billing period. You will retain access to paid features until the end of that period.
Refunds are available on a pro-rated basis within 30 days of a payment. To request a refund, contact support@proxiveil.com. Refund requests made after 30 days will be evaluated on a case-by-case basis.
All payments are processed by Stripe. We do not store your payment card information on our servers.
8. Service Level
We target 99.5% uptime for the Service, measured on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be communicated in advance when possible.
AI-powered analysis is provided on a best-effort basis. We do not guarantee specific results, accuracy, or completeness of any analysis output. Analysis reports are intended to assist security operations, not replace professional security assessment. You are responsible for validating and acting upon analysis results at your own discretion.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BC DIGITAL CONSULTING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless BC Digital Consulting LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including any misuse of uploaded data or unauthorized access facilitated by your account credentials.
11. Termination
Either party may terminate this agreement at any time. You may terminate by canceling your subscription and closing your account. We may terminate or suspend your access immediately if you violate these Terms or engage in activity that threatens the security or integrity of the Service.
Upon termination, you will have 30 days to export your data, including uploaded files and generated reports. After this 30-day period, your data will be permanently deleted from our systems. We are not obligated to retain your data beyond this period.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
13. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via the email address associated with your account. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.
